Gun bill generates email flood

Jackson Hole, Wyo.-A pair of similar bills moving through the Wyoming Legislature have generated more emails to state congressional members than any other bill in memory, according to one of Teton County’s representatives in Cheyenne.

Rep. Keith Gingery said he has received hundreds of emails from Wyoming residents who support the Wyoming Firearms Freedom Act or a related bill.
The bills would deregulate federal gun laws for any firearm made and kept in Wyoming. One gun manufacturer, Freedom Firearms, which custom makes single action revolvers, is located in Lincoln County.

Gingery said the daily deluge of emails asking him to support one of the state firearm bills reflects a growing anger toward Washington.

“The theme of the session is a very strong push-back to federal government, and a lot of bills and resolutions right now reflect that,” Gingery said in a phone interview.
The state legislature is in the second week of its annual month-long session.
While the original Wyoming Firearms Freedom Act seeks to deregulate firearms and ammunition made and permanently kept in Wyoming, the second bill takes state sovereignty a step further. House Bill HB-95 authorizes state and local law enforcement to arrest anyone who tries to enforce federal gun laws over a firearm manufactured and kept in Wyoming, including federal agents.

The lawmakers who introduced the bills argue that if a Wyoming-made gun doesn’t cross a state line, it’s not an issue of interstate commerce and therefore the federal government should have no say in the matter. Montana has passed a bill similar to the Firearms Freedom Act.

The volume of emails is due to the fact that form letters of support are circulating online. The interest from citizens in all parts of the state, including Teton County, may reflect the growing Tea Party movement nationwide that calls for less federal government.

Gingery said many of the emails he’s getting don’t support the Firearms Freedom Act, but the more aggressive HB-95.

“They say to go with House Bill 95. They almost all belittle the [Wyoming Firearms Freedom Act] as a weak bill,” he said.

The tone of some of the emails is almost confrontational.

“You’re either with us or against us,” wrote one woman who suggested the original bill be withdrawn in favor of HB-95.

A Devil’s Tower man sent an email that stated, “We need the STRONGEST state laws against the continuous encroachment of the federal government.”

Gingery on Monday said it was too soon to judge whether the bills had more than fringe support in the House. He said he had no position on the gun deregulation bills yet, but had prepared questions to ask once legislators turn to the issue in a floor discussion.

How, for example, would it affect a state law that takes away gun privileges from men convicted of domestic violence? Or what happens if a Wyoming-made gun accidentally goes to South Dakota during a hunting trip?

“This goes beyond the issue of firearms; it’s more an issue of state rights,” Gingery said. JHW

Wow. While I whole-heartedly support the gun-rights movement, some of these people... What's next, a bill to adopt the old Don't Tread On Me snake flag? As per the 10th amendment, states have little chance of successfully messing with rights already addressed in the first nine.

Yes, "You're either with us or against us" WERE words I wrote in support for Jaggi's HB-95. I and others won't be voting for the guy who votes AGAINST the likes of HB-95, it's that simple. Confrontational? I think not. Just taken out of context. Imagine my surprise at reporters and politicians behaving badly....

You Go Heidi!! Freedom and human rights can't be compromised. Those who say "I whole-heartedly support the gun-rights movement" and then turn and denounce a bill to afford and protect those rights are hypocrites. Freedom WILL ultimately prevail.

Heidi is right on. Heidi, are you going to run against your Rep. Berger if she votes against HB-95? People in Sheridan need to run against every politician over there that votes against any of the states rights bills this session. Actually, that goes for the entire state. Run them out of office because they don't have WY's best interests in mind if they will not stand up for WY against the federal government.

The SCOTUS has been extending Commerce Clause power for over 100 years and has more or less stated that business done even at a purely local level could become part of a continuous “current” of commerce that involved the interstate movement of goods and services, and thus subject to federal control. According to the Billings Gazzette, this type of bill/law is currently being tested by a group of gun advocates in Montana who have filed suit against the federal government. Time will tell...

Standing up to the federal government is far far overdue. From the 21 drinking age to the 55 speed limit, in to the real ID act, and no child left behind the legislature of Wyoming has failed to do their duty and stand up for what's best for Wyoming. Now is the time to begin taking back our state, and any office holder who doesent back that goal needs to be shown the door this fall, even if they are a republican.

Guns in the park? Now feds not being able to police people in our state? What is this place turning into, a free state? It is refreshing to see folks wising up and seeing the difference between bills with teeth and those without. The Interstate Commerce clause was extended during the Depression to allow the feds to control a farmer feeding his own grain to his own animals. Outrageous over-reach. The government closest to the people is best. The FF Act is a long overdue effort to restore local control for local issues.

This bill is a good place to start (I am going on the assumption that it will become law), but we need to keep in mind that it is only the START of restoring the liberties that have been supressed by our federal government. The U.S. Constitution limits the powers of the federal government to 18 areas, mostly concerned with our interactions with other nations (the "general welfare" clause is not an unlimited grant of power, but rather a limitation that the powers delegated be excersised only for the general welfare, as opposed to granting special considerations for selected states/groups/people. Federalist #41, #45,). ALL OTHER powers are reserved to the STATES and the PEOPLE. It is high time our state begins to interpose on behalf of the people in every area of federal overreach.

The "Firearm Freedom" acts, already the law in Montana and Tennessee, are just some of the first steps in reining in excessive Federal intrusion in personal affairs (Imperial entanglements if you prefer). The two Supreme court cases, the Heller V. DC case, decided in 2008 and McDonald V. Chicago, to he argued in March 2010, set the method by which firearm regulations can be trimmed. HOWEVER, these are more issues of 10th Amendment and 14th Amendment law, with firearms just being the arguing point. If things continue to go this way, a good thing, we will see significant changes in the coming decades. It took years to get into this sad state of affairs and will take more years to shed this excessive federal control. BTW; Regarding the issue of someone with a "Wyoming" gun stumbling into South Dakota on a hunting or target shooting trip - how would that be an interstate commerce problem? I assume he would not sell or otherwise enter into any "commerce" with it, just visit with the use of his personal property. BTW #2; Freedom Arms, a Federal Firearms Licensee manufacturing fine guns in Freedom, Wyoming, most likely will NOT be involved in testing any FF act in the courts. An individual who is NOT licensed will make one or more "Wyoming" guns for sale in the state to a resident in the state. Then the Federal government will arrest and try him for violating federal law. When I opposed the 2006 no permit-needed gun bill, I was harassed by Alan Jones (R Park) and his gun buddies in emails that said "You're dangerous...and I carry." When I complained to the House leadership for Jones exposing me to this, the next day the phone rang and an anonymous man asked, "Is this J___G___?" I said, "Yes Sir" and the jerk hung up. It turned out to have been DCI Deputy Director Kebin Haller (a serial terrorist and lowlife, as shown in this PDF file from the Governor's office: http://www.laserradio.com/subject.pdf After I captured the evidence of Haller's law breaking (using state phones to harass) he sent two thugs to my house to tamper with my willingness to expose him. Two years later, after I posted this online (Google "DCI coverup") I was run off I-80 by a DCI unmarked car. All of this, so that some insecure morons in Wyoming can pack guns like idiots. I"m the only person in the state who has been protected by FBI agents from KGB and even then in Connecticut I sure never felt a need to pack a gun. I have an assault rifle that can cut a person in half. But I don't "need" it to protect myself- except from moron Wyoming hayseeds who think ...er, don't think.

cold blue -- I did not denounce the bill, only the comments of some people indicating they would want to see states rights trump everything. The second amendment is there and it is enough; I am a second amendment absolutist. I just don't feel the need to waive my guns around to prove it. SCOTUS has already ruled bearing arms is an individual right, and the majority of citizens is on board with this. But HB-95, as it is written, could be ruled unconstitutional if passed, even by the current court. Otherwise, I have no problem protecting Freedom Arms. Rep. Professor Gingery needs to be more forthcoming on his views on this. How about it, Keith?

Don't make fun of John. The gun nuts like Neal Boortz, Ronny Reagan and Glen Beck are making it look like we all need them! John is my friend and he has only told you a small part. He was also harassed by NASA and members of the Irish stronghold. Guns should be held by trusted organizations and checked out when people want to target practice.

I feel sorry for people who seem to live constantly in fear of our ever so thinly spread government speak about gun control laws but almost in the same breath commend and promote those so-called militias (what I consider much more like terrorist training camps then gun clubs!). Talk to your neighbors, don't shoot at them! I whole heartedly agree with Jennifer, you go girl!
